On
8 December 2003, the General Assembly of the United
Nations adopted a resolution (A/RES/ES-10/I4) in
which it requested the International Court of
Justice (ICJ) to "urgently render an advisory
opinion on the legal consequences arising from the
construction of the wall being built by Israel, in
the occupied Palestinian territories, including in
and around East Jerusalem, considering the rules and
principles of international law". The ICJ, highest
judicial body of the United Nations handed down its
non-binding ruling on Friday, 9 July 2004, by (14
votes tol), declaring that the wall was illegal,
that Israel must dismantle its standing portions,
and that Israel must provide reparations for damages
caused by the construction. It also suggested that
the General Assembly and the Security Council should
consider what further action is required to bring to
an end to the illegal situation resulting from the
construction of the wall.
The General Assembly on 20th July 2004
overwhelmingly voted in favour of Advisory opinion
of the ICJ by a vote of 150 in favour to 6 against
with 10 abstentions, demanding that Israel heed
advisory opinion of the ICJ and halt construction on
its security barrier in the West Bank, tear down the
portions built on Palestinian land, and provide
reparations to Palestinians whose lives have been
harmed by the wall. The United States representative
regretted the Assembly's rush to adopt the
resolution and voted against the resolution and
emphasised that durable solution could only be found
in a negotiated settlement. Israel continues to
build what it prefers to call its "barrier", on the
grounds that it helps Israel to defend itself
against Palestinian suicide-bombers. There has been
much debate as to the content and meaning of this
opinion since it was delivered. This opinion
provides a sound overview of the legal consequences
of the construction of the wall in the occupied
Palestinian territories, and outlines the legal
obligations for both Israel and the international
community in regarding the construction. This
advisory opinion of the ICJ this ruling is a
political, moral and legal victory for Palestinians
over Israel. |
The Third Summer Course on
International Law
|
The Indian Society of International Law (ISIL),
organised the Third Summer Course on international
law at its premises from 21st June to 2nd July 2004.
Dr. R.K. Dixit, former Joint Secretary & Legal
Adviser, Ministry of External Affairs(MEA)
inaugurated the course on 21st June 2004. Shri Ram
Niwas Mirdha, President, ISIL welcomed the
participants of the programme. Shri Narinder Singh,
Joint Secretary, Legal and Treaties Division, MEA,
proposed the vote of thanks. The s ubstantive
sessions of the course were spread over ten days.
Lectures were delivered on important and
contemporary areas of Public International Law,
Private International Law, International
Institutions, International Human Rights,
Humanitarian and Refugee Laws, International
Business and Trade Law, International Environmental
Law and International Criminal Court. 130
participants including, students, teachers and
lawyers from various parts of the country attended
the course. Dr.Manoj Kumar Sinha, Assistant
Professor, ISIL was the course coordinator.
The faculty for the summer course comprised of
eminent international law experts such as Prof.
Lakshmi Jambholkar, Prof.Veena Bakshi, Prof.J.LKoul,
Shri A.K.Ganguly, Dr.R.K.Dixit, Shri C.Jayaraj, Shri
Rajeev Ranjan, Larry Maybee, Regional Legal Adviser
of ICRC, Ms. Carol Batchelor, Deputy Chief of the
Mission, UNHCR, Shri M.K.Rao, Dr.A.S.Reddy,
Dr.V.D.Sharma, Shri Luther Rangreji, Shri Sanjay
Parikh, Dr.Ch.Banerjee, Shri James Nedumpara and
Dr.Manoj Kumar Sinha. The whole course witnessed
lively interactions and discussions by the
participants. They were provided with reading
materials including a copy of the Indian Journal of
International Law. The course was concluded on 2nd
July. Hon'ble Vikramjit Sen, Judge High Court of
Delhi, was the Chief guest, and while delivering the
valedictory address, he recalled his association
with the Society for last three decades. He pointed
out the growing importance of international law at
all levels and exhorted participants to take
international law study seriously. He also
distributed the certificates to the participants. Shri C.Jayaraj, Secretary- General gave the vote of
thanks.
The UGC Refresher Course on
International Law
The Society organised a UGC Refresher Course on
International Law for law teachers at its premises
from 6th September to 25th September. Prof.
K.K.Aggarwal, Vice- Chancellor, Guru Gobind Singh
Indraprashta University, delivered the inaugural
address. Shri Ram Niwas Mirdha, President, Society,
welcomed the chief guest and the participants. Dr.
G.V.G. Krishnamurthy, former Election Commissioner
of India presided the meeting. Prof. A.K.Koul,
Course-Coordinator, proposed the vote of thanks.
There were lectures and presentations on various
branches of international law.
The faculty for the refresher course comprised of
eminent international law experts such as: Prof.
R.P.Anand, Prof.V.C.Govindaraj, Prof. Lakshmi
Jambholkar, Prof.Veena Bakshi, Prof. A.K.Koul,

course-coordinator.
The course was concluded on 25th September. Prof.
K.N. Chandrashekhran Pillai, Director, Indian Law
Institute delivered the valedictory address and
distributed the certificates to the participants.

The Inauguration of PG Diploma
Courses for the Academic Year 2004-2005
and Award of Diploma Certificates for
the year 2003-2004

The Inauguration of PG Diploma courses for the
academic year 2004-05 and award of Diploma
certificates for the academic year 2003-2004 was
held on 21st September 2004 at the Society's
premises. Shri Kapil Sibal, Minister of State for
Science and Technology & Ocean Development, was the
chief guest. In his speech he highlighted the
importance of the role of international law in
present times and also appreciated the role Society
has been playing in the dissemination of
international law through research, teaching and
publications. He distributed the diploma
certificates to the successful students for the
academic year 2003-2004. Shri Ram Niwas Mirdha,
President, welcomed the chief guest. Shri
R.K.P.Shankardass, Vice- President, ISIL, gave the
vote of thanks.
ISIL Honours Kamal Hossain, A Renowned Scholar
In association with Supreme Court Bar
Association, the Society organised a lecture on
International Law and Sustainable Development - Need
for International Cooperation" by Dr.Kamal Hossain,
Vice Chairman of the International Law Association
and an eminent jurist from Bangladesh, on 1st
September 2004 at Society's premises. Hon'ble
Justice Y.K.Sabharwal, Judge, Supreme Court of
srnational 1st from I K.Sab India, presided over the
function. Shri Ram Niwas Mirdha welcomed the
gathering. Shri Vijay Hansaria, Vice-President,
Supreme Court Bar Association gave vote of thanks.
On this occasion the Society conferred the honorary
membership of the ISIL to Kamal Hossain for his life
long service for development of the international
law and for projecting the views of developing
countries in the process of international law
making.
Lecture on German
Constitution The Indian Society of
International Law and Supreme Court Bar Association
jointly organised a lecture on German Constitution
by Hon'ble Madam Dr.Beate Merk, State Minister for
Justice, Free State of Bavaria, Germany, on 31sl
August 2004 at Society's premises. Hon'ble Justice N
Santosh Hegde, Judge, Supreme Court of India,
presided over the function. Shri G.V.Rao welcomed
the gathering. Ms. Pareena Swamp, Secretary, Supreme
Court Bar Association gave vote of thanks.
FORTHCOMING EVENTS
Fourth Henry Dunant Memorial Court Competition
The Indian Society of International Law (ISIL) and
the International Committee of the Red Cross (ICRC)
will be jointly organizing the Fourth Henry Dunant
Memorial Moot Court Competition on 16th -17th
October 2004. The Moot court is designed to give
wider dissemination to and raise awareness of
International Humanitarian Law (IHL) issues amongst
law students in India.
Second International Conference On International
Law
The Indian Society of International Law (ISIL) is
organising its 2nd International Conference on
International Law from 14-17 November 2004, in New
Delhi. The Second International Conference is being
organized to provide a forum for in-depth discussion
on the emerging trends in various branches of
international law among the practitioners, teachers
and scholars of international law from different
nationalities. The following are the tentative

Dynamics of International Law in the New Millennium

The book Dynamics of International Law in the New
Millennium, edited by Dr. R.K.Dixit Former Legal
Adviser, Ministry of External Affairs and C. Jayaraj,
Secretary-General of ISIL, is collection of essays
contributed by international experts from different
parts of world at the First International Conference
on International Law, International Law in the New
Millennium, organised by the Indian Society of
International Law, in 4-7 October 2001, at New
Delhi. The contributions reflect the complexities of
transition of international law at the turn of the
millennium. The authors have addressed various
